License to Use LAWASSA LMS

LAWASSA – LMS Operational Terms and Conditions

To balance legal protection with user-friendliness. Here are key elements of this terms and conditions are as follows

User Agreement:
  • Acceptance: Clearly state that using the LAWASSA LMS constitutes acceptance of the Terms.
  • User Obligations:
    • Adherence to intellectual property rights as per prevailing law of Republic of India as applicable .
    • Both the owner as well have the Responsible and ethical use of the platform.
    • Compliance with applicable laws and regulations of Republic of India.

    • User responsibility for password security.
    • Notification of unauthorized access.
  • Data Privacy and Security:
    • Commitment to data protection and privacy.
    • Data usage and sharing policies.
    • Data retention and deletion procedures.
Intellectual Property Rights:
  • Ownership: LAWASSA will remain the sole owner, including courses, materials, and software developed for this LMS.
  • Licensing: The user license under predefined condition of registration were granted license as users (e.g., non-exclusive, non-transferable).
  • Restrictions: The owner of LAWASSA-LMS has the power to restrict on content usage, such as redistribution or modification or alteration or quoting reference and thereby all activities of content creation under LAWASSA-LMS platform.
Service Provision and Access:
  • Service Availability: Five type of level of course availability and potential downtime is explained in sperate section.
  • User Access: The users are responsible themselves for making swift use of LAWASSA – LMS online learning at their end with the adopted technology including device compatibility and internet requirements.
  • Service Modifications: Reserve the right to modify or discontinue services with reasonable notice.
Payment and Fees:
  • Payment Terms: Details payment methods, currency, and due dates are notified along with the course separately.
  • Fees and Charges: The fee structure, including any additional charges or taxes are described along with the course in separate section.
  • Refunds and Cancellations: Establish refund and cancellation policies.
Limitation of Liability:

  • Liability Limits: Limit liability for damages, including indirect, incidental, and consequential damages will be not more than 100 USD.
Termination:
  • Termination by User: As mentioned above.
  • Termination by LAWASSA LMS: Specify grounds for termination by LAWASSA LMS, such as breach of terms or non-payment etc.
  • Effects of Termination: The LAWASSA is not responsible for any consequences of termination, including loss of access and data.
Dispute Resolution:
  • Governing Law: The governing law for the agreement as per Republic of India Law
  • Dispute Resolution: The dispute resolution mechanism, such as self-negotiation or mediation or arbitration. When none of these option found viable than take the help of prevailing law of Republic of India.
Modifications to Terms:
  • Right to Modify: Reserve the right to modify the Terms with reasonable notice.
  • Notification: Accordingly the users will be notified of changes time to time.
Additional Considerations:
  • Accessibility: LAWASSA – LMS online course are not fit for the user having hearing/speech/mentally retarred/illness/physical disabilities.
  • Third-Party Services: If using third-party services, incorporate relevant terms and conditions under special circumstance taking relevant permission from administration division of LAWASSA – LMS.
  • Force Majeure: LAWASSA LMS is not responsible for any “superior force,” which refers to unforeseeable circumstances or events that prevent the registered/future users from fulfilling a specialized contractual obligation. Here the user meanings the learner and faculty members (Course developer)
  • Indemnification: LAWASSA LMS being educational platform only agrees to compensate 100 USD ONLY to another party for potential losses, damages, or legal liabilities arising from specific circumstances or actions.
  • Notice and Communication: Any fraudulent/unauthorized activities detected or noticed will be first warn with official notice and if not resolve than legal procedure will be followed under the prevailing law of Republic of India.
